Justice Sotomayor Upholds New York Vaccine Mandate

Rejects argument made by a police detective.

This week, Supreme Court Justice Sonia Sotomayor declined Detective Anthony Marciano’s request for a stay of New York’s vaccination requirement for municipal workers. Justice Sotomayor is the judge designated to oversee the Second Circuit which covers the states of Connecticut, New York, and Vermont. She made her decision after the case was appealed. This is the second time the detective filed against the vaccination mandate. His first challenge was also denied.

While the COVID-19 vaccines have been approved for emergency use by the Food and Drug Administration, Detective Marciano argued in his legal filing that “he cannot and will not assume the health risks associated with an illegal, experimental” vaccine that he “does not need.” Though the detective remains unvaccinated, he remains on active duty until the case is fully resolved.
